These Terms of Service ("Terms") are established by FUNTEK Technology Co., Ltd. ("FUNTEK") and apply to the PinChat website (https://pinchat.app/) and related iOS and Android applications (collectively referred to as "PinChat"). These Terms constitute a legally binding agreement between users of PinChat services ("Users" or "You") and FUNTEK.

Please read and understand all contents of these Terms carefully before using PinChat. If you do not agree with any part of these Terms, please do not use PinChat services. For personal data protection policies, please refer to PinChat's Privacy Policy and Data Processing Agreement.

I. Definitions

The following terms used in these Terms are defined as follows:

1. "Content":Refers to text (including chat records), voice, music, images, videos, stickers, software, programs, code, links, contact information, location information, and any information that can be sent or received through PinChat.

2. "Submission":Refers to content actively uploaded by users to PinChat, excluding user communication conversations.

3. "Account":Refers to the unique identity obtained by users through registration on PinChat for using PinChat services.

4. "Service":Refers to all functions, features, and related services provided by FUNTEK through the PinChat website and applications.

II. Account Registration and Usage

1. Acceptance of Terms:By completing registration, you agree to these Terms and shall use PinChat in accordance with these Terms.

2. Authorization Requirements:If users are required by relevant laws to obtain consent or authorization from specific persons (such as legal guardians) to use the service, you must obtain such consent or authorization on your own, which is not related to FUNTEK. If you complete registration, it is deemed that the aforementioned specific persons have consented to or authorized acceptance of these Terms.

3. Compliance with Regulations:Users shall comply with other relevant regulations of PinChat for members. To ensure users' rights, it is recommended that users regularly check the latest announcements of these Terms and usage instructions.

4. Data Authenticity:If users provide any false, untrue, or incomplete personal information (including but not limited to mobile phone numbers, credit card information), PinChat has the right to suspend or terminate your account and refuse your use of all or part of PinChat services.

5. Account Responsibility:

   1. Users must be responsible for any activities that occur through their account
   2. Users agree not to sell, transfer, license, or assign their account, followers, username, or any account rights
   3. Unless explicitly authorized (to create accounts on behalf of employees or clients), PinChat prohibits creating accounts for anyone other than yourself

6. Non-Applicable Regions:If users cannot comply with or agree to the contents of these Terms, or if the user's country or region excludes part or all of these Terms, please immediately stop using the PinChat website and applications.

III. Usage Guidelines

When using PinChat services, users shall comply with the following guidelines:

1. API Usage Restrictions:Users shall not access PinChat's API in ways not permitted by PinChat.

2. Prohibited Content:Users shall not post photos or other content containing violence, nudity, partial nudity, discrimination, illegality, infringement, hatred, pornography, or sexual implications through PinChat.

3. Behavior Restrictions:Users shall not engage in the following behaviors:

   1. Defamation, stalking, coercion, abuse, harassment, threats, impersonation, intimidation of others or institutions
   2. Posting private or confidential information through PinChat, including but not limited to credit card information, ID numbers, non-public phone numbers, or non-public email addresses of users or others

4. Legal Use:Users shall not use PinChat for any illegal or unauthorized activities.

5. Prohibition of Modification:Users shall not change, modify, adapt, or alter PinChat, or change, modify, or alter other websites and services in a way that would cause confusion about their relationship with PinChat.

6. Network Security:Users shall not interfere with or affect servers and networks connected to PinChat, including but not limited to sending any computer worms, viruses, spyware, malware, or other destructive or disruptive code.

7. Display Protection:Users shall not insert content or code, change, or interfere with the presentation or display of any PinChat page in the user's browser or device.

8. Prohibition of Automated Use:Users shall not create PinChat accounts through unauthorized means, including but not limited to using automated devices, scripts, automated programs, spiders, crawlers, or scraping programs.

9. Prohibition of Interference:Users shall not attempt to prevent other users from using PinChat, nor shall users encourage or provide ways to violate these Terms or other PinChat terms.

10. URL Ownership:For all instant messaging URLs created through PinChat, if the URL name is a trademark or name already registered by another company or individual, PinChat has the right to return the URL to the owner and delete related chat messages and personal information after receiving a complaint from the owner.

IV. Limitation of Liability

1. Limited Liability:Users understand and agree that, except in cases where PinChat can be clearly proven to have intentional or gross negligence in fulfilling services, PinChat shall not be liable for any damages caused by users' use or inability to use PinChat services. In any case, PinChat's liability to users shall be limited to the system service fees collected in the current year.

2. System Anomaly Handling:

   1. If there are any system anomalies, please contact service@pinchatcorp.com
   2. Service hours are 10:00-12:30/13:30-18:00 on working days (excluding national holidays, which are subject to the announcement by the Directorate-General of Personnel Administration).
   3. When PinChat service is suspended or abnormal, PinChat shall be responsible to users according to the following levels and compensation methods:
      1. System suspension within 30 minutes: PinChat will not provide additional compensation.
      2. System suspension exceeding 30 minutes: Calculated by the hour, and if service suspension continues, it will be rounded up to the hour (e.g., if suspended for one and a half hours, it will be calculated as two hours), with proportional refunds according to the subscription plan based on suspension time.

3. Service Interruption Exemptions:When the following circumstances occur, PinChat service will be interrupted or suspended, and users may not request any fee refund or claim damages from PinChat, but PinChat shall notify users to a reasonable and feasible extent:

   1. Due to software or hardware accidents, failures, anomalies, or interruptions of telecommunications or cloud service providers (including but not limited to Amazon Web Services).
   2. When there are specific facts indicating potential impact on consumer rights, including but not limited to suspected attacks or criminal acts by unknown third parties, and PinChat determines that suspending PinChat service is appropriate.
   3. When users use improperly, or when data or account passwords are lost or leaked, to avoid damage expansion.
   4. Pre-notified system machine room migration, maintenance, upgrades, disaster recovery drills, etc.
   5. Other circumstances not attributable to PinChat or force majeure events.

4. Function and Content Liability:PinChat does not guarantee or assume any liability for any damages caused by any functions, content, or submissions. Users should use PinChat in a normal and reasonable manner and bear the aforementioned risks and damages.

5. Infringement Liability:Users shall bear the risk for any content or submissions generated on PinChat that involve infringement. PinChat has no obligation to determine whether submissions or content infringe rights.

V. Refund Policy

1. Free Trial Plan:

   1. If you are using PinChat's free plan or trial version, no payment is required, therefore no refund is involved.
   2. We recommend fully utilizing the free trial features before upgrading to a paid plan to ensure the product meets your needs.

2. Monthly Plan:

   1. Monthly plans take effect from the payment date, and once paid, partial refunds are not possible.
   2. Users can contact us to cancel their subscription at any time after purchasing a monthly plan, but the service will continue until the end of the current billing cycle, and paid fees will not be refunded.
   3. If duplicate charges occur due to system errors or special circumstances, please contact us, and we will process the refund within 5 working days.

3. Special Events/Discount Plans:

   1. Unless otherwise explicitly stated in the event, plans purchased through special promotions, limited-time discounts, or cooperative channels are non-refundable once paid.
   2. If users cannot normally enjoy event/discount plan services due to PinChat system errors or malfunctions, PinChat will provide corresponding compensation or refund after verification.

4. Refund Process:

   1. Please send refund applications to: service@pinchatcorp.com, including the following information in the email:
      1. Purchase account (email)
      2. Purchase plan type and time
      3. Reason for refund
   2. After review and approval, we will complete the refund process within 5-10 working days (may vary depending on the payment platform).
   3. PinChat reserves the final right to decide on refunds and may block or terminate service for accounts that maliciously use or abuse the refund mechanism.

VI. Content Ownership

1. User Content:

   1. Users retain ownership of content they create, upload, or share on PinChat.
   2. Users grant FUNTEK a non-exclusive, worldwide, royalty-free license to use, copy, modify, distribute, publish, and process content uploaded to PinChat, limited to the following purposes:
      1. Providing, maintaining, and improving PinChat services
      2. Developing new features and optimizing user experience
      3. Processing user support requests and issues
      4. Ensuring service security and compliance
      5. Necessary purposes as described in these Terms and Privacy Policy

2. FUNTEK Content:

   1. All rights, ownership, and interests in PinChat services, including all related intellectual property rights, belong to FUNTEK.
   2. These Terms do not grant users any rights to use FUNTEK's trademarks, logos, domain names, or other brand features.

VII. Terms Modification

FUNTEK reserves the right to modify these Terms of Service and refund policy at any time, with the official website announcement being the standard. Major changes will be notified to users through the PinChat website or application. Users' continued use of PinChat services indicates acceptance of the modified terms.

VIII. Termination

1. User Termination:Users may stop using PinChat services and terminate this agreement at any time. To delete an account, please use the settings option in the application or contact customer support.

2. FUNTEK Termination:If users violate any provision of these Terms, FUNTEK may suspend or terminate your account or all or part of your access to PinChat services without prior notice.

IX. Other Terms

1. Complete Agreement:These Terms constitute the complete agreement between users and FUNTEK regarding PinChat services and supersede any previous agreements.

2. Governing Law:These Terms are governed by the laws of the Republic of China, without regard to its conflict of law principles.

3. Terms Severability:If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

4. Rights Reservation:FUNTEK Technology Co., Ltd. reserves the right to interpret these Terms in accordance with the law.
